Rechtliche Hinweise

Unabhängige Anwendung PokéCatalog ist eine unabhängige Anwendung von AKKD — Andreas Kuschner Kommunikationsdesign. Die Anwendung ist weder mit Nintendo, Creatures, GAME FREAK, The Pokémon Company oder The Pokémon Company International verbunden noch wird sie von diesen Unternehmen unterstützt, autorisiert oder empfohlen.

1. Marken und urheberrechtlich geschützte Inhalte

Pokémon, Pokémon-Charakternamen, Kartennamen, Set-Bezeichnungen, Symbole, Logos, Kartenillustrationen, Kartendesigns und sonstige zugehörige Inhalte sind Marken, urheberrechtlich geschützte Werke oder sonstiges geistiges Eigentum ihrer jeweiligen Rechteinhaber.

PokéCatalog verwendet Bezeichnungen und – soweit verfügbar – Kartenabbildungen ausschließlich zur Identifizierung, Dokumentation und Verwaltung der vom Nutzer erfassten Sammelkarten. Aus dieser Darstellung folgt weder eine Übertragung von Rechten noch eine Aussage über eine Lizenzierung durch die jeweiligen Rechteinhaber. Sämtliche Rechte an Drittinhalten verbleiben bei den jeweiligen Rechteinhabern.

2. Daten- und Bildquellen

Für Kartenidentifikation, Kartendaten, Marktinformationen und ergänzende Informationen nutzt PokéCatalog unter anderem TCGdex, pokemontcg.io, PokeAPI, Cardmarket, Yuyutei, Google Gemini, Apple-Dienste sowie eigene qshi.de-Dienste. Kartenabbildungen können unmittelbar von externen Datenquellen geladen werden und sind nicht Bestandteil einer Übertragung von Bildrechten an AKKD.

Die Nennung oder technische Nutzung eines Drittanbieters bedeutet keine Partnerschaft, Empfehlung oder Gewährleistung durch diesen Anbieter. Für Verfügbarkeit, Vollständigkeit und Fehlerfreiheit externer Inhalte kann keine Garantie übernommen werden.

3. TCGdex

Die TCGdex-Kartendatenbank wird von TCGdex bereitgestellt und im zugehörigen Repository unter der MIT-Lizenz veröffentlicht. Die MIT-Lizenz der Datenbank erfasst nicht automatisch unabhängige Rechte Dritter an Pokémon-Marken, Kartenillustrationen oder sonstigen Karteninhalten.

4. Nutzeraufnahmen

Vom Nutzer aufgenommene Kartenfotos werden nach Maßgabe der Datenschutzerklärung verarbeitet. PokéCatalog veröffentlicht diese Aufnahmen nicht. Nutzer sind selbst dafür verantwortlich, Karten und sonstige Inhalte nur in einem Umfang aufzunehmen, zu speichern oder weiterzugeben, zu dem sie berechtigt sind.

5. Marktpreise und Bewertungen

Marktpreise und Preisverläufe basieren insbesondere auf dem öffentlich bereitgestellten Price Guide von Cardmarket, dem europäischen Marktplatz für Sammelkarten. Cardmarket ist eine Marke der Sammelkartenmarkt GmbH & Co. KG; die Nennung dient ausschließlich der Quellenangabe. Preise japanischer Karten können ergänzend auf Angebotsdaten von Yuyutei (yuyu-tei.jp) beruhen.

Angezeigte Marktpreise, Preisverläufe, Zustandsangaben und sonstige Einschätzungen dienen ausschließlich der unverbindlichen Orientierung. Sie sind keine Kauf-, Verkaufs-, Anlage- oder professionelle Bewertungsberatung. Tatsächliche Verkaufspreise können insbesondere aufgrund von Zustand, Sprache, Variante, Nachfrage und Marktliquidität erheblich abweichen.

6. Rechtehinweis und Kontakt

Sollten Rechteinhaber der Auffassung sein, dass Inhalte unberechtigt angezeigt oder bezeichnet werden, bitten wir um eine Nachricht mit einer möglichst konkreten Bezeichnung des betroffenen Inhalts. Nachvollziehbare Hinweise werden zeitnah geprüft.

1. Trademarks and copyrighted content

Pokémon, Pokémon character names, card names, set names, symbols, logos, card artwork, card designs, and related content are trademarks, copyrighted works, or other intellectual property of their respective owners.

PokéCatalog uses names and, where available, card images solely to identify, document, and manage trading cards recorded by the user. Their display does not transfer any rights or represent that the respective rights holders have granted a licence. All rights in third-party content remain with their respective owners.

2. Data and image sources

For card identification, card data, market information, and supplementary information, PokéCatalog uses services including TCGdex, pokemontcg.io, PokeAPI, Cardmarket, Yuyutei, Google Gemini, Apple services, and AKKD's own qshi.de services. Card images may be loaded directly from external data sources. This does not transfer image rights to AKKD.

Naming or technically using a third-party service does not imply a partnership, endorsement, or warranty by that provider. No guarantee is made regarding the availability, completeness, or accuracy of external content.

3. TCGdex

The TCGdex card database is provided by TCGdex and published in its repository under the MIT License. The database's MIT License does not automatically cover independent third-party rights in Pokémon trademarks, card artwork, or other card content.

4. User photographs

Card photographs taken by users are processed as described in the Privacy Policy. PokéCatalog does not publish these photographs. Users are responsible for capturing, storing, or sharing cards and other content only to the extent they are entitled to do so.

5. Market prices and assessments

Market prices and price histories are primarily based on the publicly available Price Guide provided by Cardmarket, the European marketplace for trading cards. Cardmarket is a trademark of Sammelkartenmarkt GmbH & Co. KG; it is named solely for the purpose of source attribution. Prices of Japanese cards may additionally be based on listing data from Yuyutei (yuyu-tei.jp).

Displayed market prices, price histories, condition information, and other assessments are provided for general guidance only. They do not constitute purchasing, sales, investment, or professional appraisal advice. Actual sale prices may differ substantially depending on condition, language, variant, demand, and market liquidity.

6. Rights notices and contact

If a rights holder believes that content is being displayed or identified without authorisation, please contact us and identify the affected content as precisely as possible. Substantiated notices will be reviewed promptly.
